Section A - Access by Reddit, Inc. Employees, contractors, counsels or other agents acting on behalf of Reddit Inc.
In this section "Reddit agent" means any physical person acting or intending to act on behalf or direction of Reddit Inc.
As a Reddit agent by accessing PullPush on behalf of Reddit Inc. You cerifty that you are duly authorised by Reddit Inc. to enter into this binding agreement.
If a Reddit agent is not authorised by Reddit Inc to enter into this agreement on behalf of Reddit Inc, they may not access any PullPush websites, API, forum, ticket or email systems. Such unauthorised access is usually a criminal matter in your country of origin.
Section B - Binding Arbitration
The terms of this section shall apply to all Disputes between you and PullPush. The term "Dispute" is meant to have the broadest meaning permissible under law and includes any dispute, claim, controversy or action between you and PullPush arising out of or relating to this Agreement, PullPush branded products (hardware and including any related software), or other transaction involving you and PullPush, whether in contract, warranty, misrepresentation, fraud, tort, intentional tort, statute, regulation, ordinance, or any other legal or equitable basis.
Binding Arbitration. You and PullPush agree that all Disputes shall be resolved by binding arbitration according to this Agreement. ARBITRATION MEANS THAT YOU WAIVE YOUR RIGHT TO A JUDGE OR JURY IN A COURT PROCEEDING AND YOUR GROUNDS FOR APPEAL ARE LIMITED. Pursuant to this Agreement, binding arbitration shall be administered by Ivan Petrov, a Russian national of no fixed address.
PullPush shall locate Ivan Petrov and pay him for his services. This may include payments in kind.
Arbitration shall not proceed until after Ivan has consumed his payment.
Section C - Governing law
- This Agreement shall be governed by, and construed in accordance with, the laws of the Russian Federation, each of the Parties hereby submits unconditionally to jurisdiction of, and agrees that venue shall lie exclusively in the Russian Federation for purposes of the resolution of any disputes arising under this Agreement.
Section C - General disclaimer
THE SERVICE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SERVICE OR THE USE OR OTHER DEALINGS IN THE SERVICE.
